  • A legal separation in Ontario occurs when you and your former partner (married or common law), are living “separate and apart” due to a “break down in the relationship”.

  • Decision-making responsibility and parenting time is decided based on what is in the “best interests of the children.”

  • In Ontario, children have the right to financial support from both of their parents. Child support is the amount of money that one parent pays to the other parent to help pay for the basic costs of caring for the child after separation or a divorce.

  • When married couples separate, either party may make a claim for spousal support under the Divorce Act, however, in most cases spousal support is usually requested by the lower income earner.

  • Division of property and equalization relates to the assets and liabilities accumulated by the parties during their marriage, collectively called the “Net Family Property” (NFP).

  • Domestic contracts are legal agreements where parties define the terms of their relationship with one another. Such domestic contracts include cohabitation agreements, marriage contracts and separation agreements.

  • A Separation Agreement allows parties to agree on the terms of their separation upon their relationship breaking down including setting terms about parenting, support and property division.

  • Alternative Dispute Resolution or “ADR” is an out-of-court process that couples may use to resolve their family law issues as an alternative to going to court.

  • A valid Will is important as it allows you to coordinate the distribution of your property according to your wishes and makes the distribution of your assets an easier process for your loved ones and beneficiaries.

  • Unbundled services allow you to obtain legal services that fit your needs and budget without formally retaining a lawyer. They could include general coaching, provision of information about court procedures and law, or assistance with just one step within an overall case.
